The Building Safety Act 2022 required principal accountable persons (PAPs), or someone authorised by them, to register all high-rise residential buildings 18 metres or 7 storeys tall or higher, with 2 or more residential units with the Building Safety Regulator by 1 October 2023.
This deadline has now passed and the HSE has advised that over 13,000 duty holders have started or completed their application. However, the HSE is reminding any PAPs who have missed the deadline to take prompt action. This is crucial, because under s77 of the Building Safety Act 2022 it is a criminal offence for the PAP to allow residents to occupy such a building when not registered.
Further, under s76 from 1 October 2023 all new buildings must be registered and a completion certificate obtained before occupation. As with existing buildings it is a criminal offence for the PAP to allow residents to occupy an unregistered building before a completion certificate is issued.
In both cases, offences may be punished by an unlimited fine or imprisonment for up to two years.
